Cases/Charges Ineligible for Diversion

Restitution in excess of $400: If the case involves victim restitution in an amount equal to or less than$400, the defendant may be referred to diversion as set forth herein. However, full payment of restitution within a six-month period is required or the case will be terminated unsuccessfully from the CAD program.
PC 290 Cases: The charges are for an offense in which registration pursuant to PC 290 is compulsory or discretionary.
Vehicle Code: Charges pursuant to Vehicle Code sections 2800.1, 2800.2, 14601, 14601.3, 14601.4, 14601.5, 14601.2, 21340, 23152 or 23153.
Firearms: Any case involving the illegal possession or use of a firearm or ammunition.
Marsy's Law: Any case where the grant of pretrial diversion would violate the rights of a victim as defined in Marsy's law and the California Constitution.
